OPINION

LEDERBERG, Judge.

This ease came before the Supreme Court on the appeal of the defendant, Kyle Campbell, from a judgment of conviction of one count of first-degree murder. On appeal, the defendant contended that the trial justice improperly admitted into evidence the defendant’s statements to the police and certain DNA evidence. The defendant also argued that the trial justice erred by denying the defendant’s motion to pass the case and by refusing to instruct the jury on second-degree murder.
