Plaintiff, who was employed by defendant Albertson’s Inc. (Albertson’s) until January 2000, brought this action in circuit court to recover alleged unpaid overtime and termination wages pursuant to Oregon’s wage and hour laws and the federal Fair Labor Standards Act (FLSA). Albertson’s moved for summary judgment, arguing that plaintiffs claims are precluded by a prior federal judgment in a class action in which plaintiff was a member.
