MEMORANDUM OPINION AND ORDER

DOWD, District Judge.

Before the Court are three motions for summary judgment filed by the defendants. 1 The motions have been fully briefed and are ripe for determination.

I. BACKGROUND

This ease, removed from the Common Pleas Court of Tuscarawas County, involves an effort by the plaintiff Nationwide Mutual Fire Insurance Co.
