OPINION.

ROBERTS, C. J.

On, or shortly before October 15th, 1912, the Bank of San Marcial, collected a life insurance policy for the defendant, McCrory, in the sum of two thousand dollars. From the amount so collected it made certain deductions, and payments on the order of Mc-Crory, and on the morning of the 16th of October thereafter there remained in the ¡Dossession of the bank, to the credit of McCrory, the- sum of $1,412.58.
