OPINION AND ORDER

NINA GERSHON, District Judge.

Plaintiff Kevin Nelson brings this action against defendants Special Agent John Chang and Detective David Intrator for false arrest, false imprisonment, and negligence. 1 Specifically, Nelson asserts First and Fourth Amendments claims pursuant to Bivens v. Six Unknown Named Agents of the Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971).
