Randy Lee Matkins was convicted of the murder of James Willie Askins, Jr., and was sentenced to life imprisonment without parole as a habitual felony offender. On appeal, his conviction was reversed. Matkins v. State, 497 So.2d 194 (Ala.Cr.App. 1985), affirmed, 497 So.2d 201 (Ala. 1986). Upon retrial, Matkins was again convicted of murder and sentenced to life imprisonment without parole. One issue is raised on appeal from that second conviction.
