Petitioner Balachandran Rajáratnam, a citizen of Sri Lanka and ethnic Tamil, seeks review of a decision that he is not entitled to attorneys’ fees under the Equal Access to Justice Act (“EAJA”). For the reasons set forth in the following opinion, we vacate the judgment and remand the case to the district court for proceedings consistent with our opinion in Alpern v. Lieb, 38 F.3d 933 (7th Cir.1994).
