LOWELL, Circuit Judge.
This is a suit brought under sections 1 and 3 of the Interstate Commerce Act of February 4, 1887, c. 104, 24 Stat. 379, 380 [U. S. Comp. St. 1901, pp. 3154, 3155], to recover damages alleged to have been sustained by its violation.
The plaintiff is a dealer in hay at Forest Hills, a suburban station. *695within the city limits of Boston. At Forest Hills the defendant allows hay to remain in the freight cars without charge for 96 hours after its receipt.
