Appellant filed a claim against the county for services, under a contract with the board of commissioners, in examining and reporting the condition of the accounts of the late treasurer of said county, and for damages for a breach of the contract by the board of commissioners.

On motion of appellee’s counsel the claim was, dismissed by the board of commissioners. Appellant appealed to the circuit court, where, upon the renewal of the same motion, the claim was dismissed in the circuit court, and the claimant *404has appealed to this court.
