Appeal from a judgment of the County Court of *1160Ulster County (Bruhn, J.), rendered July 24, 2007, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the fourth degree.

After an alleged sale of cocaine and heroin to an undercover police officer, defendant was charged in a four-count indictment with two counts of criminal sale of a controlled substance in the third degree and two counts of criminal possession of a controlled substance in the third degree.
