When the matter was presented to the Franklin County grand jury, two felony counts of criminal contempt in the first degree were charged based upon defendant’s alleged assault of Schofield, and one count of criminal contempt in the second degree, a misdemeanor, was charged based upon defendant’s use and consumption of alcohol that night. Defendant waived immunity and testified on his own behalf, admitting that he had consumed alcohol that evening.
