MURRAY, Justice.

This case comes before us on appeal by Lewis A. Perrotti (Perrotti) from a Superior Court order denying his petition for a permanent injunction to enjoin the defendants, Anthony J. Solomon (Solomon), the former state General Treasurer and chairman of the Retirement Board of the Employee’s Retirement System of the State of Rhode Island (retirement board), and James M.
