Appellee, H. Bascom Thomas, sued appellant, Sim M. Shelton, in the county court at law of Dallas county to recover the sum of $500, which he alleged appellant had agreed to pay him as a fee for representing him in an advisory capacity only with reference to certain matters not then in litigation. He alleged that appellant gave him a check in the sum of $300 on said fee at the time of employment, and agreed to pay him the remaining $200 at a later date.
