Defendant was convicted of criminal trespass in the first degree, ORS 164.255, and was ordered to pay $400 in court-appointed attorney fees. On appeal, he makes two assignments of error. First, he challenges the trial court’s denial of his motion for judgment of acquittal; we reject that contention without published discussion. In his second assignment of error, defendant contends that the trial court erred in imposing attorney fees in the absence of evidence in the record of his ability to pay those fees as required by ORS 151.505(3).
