This was- a suit for the specific performance of a parol agreement for the sale of land. There was a demurrer to the petition, upon the ground that there was no equity in it. The demurrer was "sustained, and we are to determine whether the court below erred in thus ruling. It is not until we reach the fourth paragraph of the petition, and only in that paragraph, that we find the statement of the parol agreement which the plaintiff asks the court to specifically enforce.
