1. This case was before the court at June Term, 186r, upon exceptions to a decision modifying the temporary injunction which had been ordered. 39 Ga., 533. It was finally tried upon the pleadings'as they then appeared, together with an amendment, which was suggested by the opinion delivered at that time. So far as concerns the principles then laid down, as being applicable to the matters in controversy between the parties, it is scarcely necessary to remark that they are res adjudicate and binding both upon this and the lower court, in all further trials of the case.
