OPINION OF THE COURT
BARRY, Circuit Judge.
In this case, we are asked to review the grant of summary judgment in favor of an insurer and damages awarded by the District Court to the insurer. Por the reasons that follow, we will affirm in part, reverse in part, and remand for further proceedings.
I. BACKGROUND
