I. Introduction
This case is before the Court on Defendant’s Motion for Summary Judgment pursuant to Rule 56 of the Rules of the Court of Federal Claims (RCFC). Defendant contends that it was justified in terminating for default its contract with the Plaintiff, Engineered Maintenance Services, Inc. (“EMS”). According to Defendant, Plaintiff failed to give proper notice of its claim for differing site conditions and, moreover, cannot successfully assert excusable delay under the differing site condition clause.
