C. M. Bridgeman. as plaintiff in the lower court, filed an action to require Joseph Franks to account for the profits derived from a certain sheep-raising venture jointly engaged in by the parties over a period of approximately three years from 1931 to 1934. To this petition Franks filed an answer and cross-petition setting out certain mutual accounts between the parties and praying damages for the loss of certain sheep • alleged to have been caused by the negligence of Bridgeman, and further prayed for the return of certain personal property.
