On July 14, 1916, defendant in error, G. D. Donaldson, in the district court of Bryan county, filed Ms motion for a writ of mandamus against plaintiff in error, James Yarbrough, mayor of the city of Durant, requiring him to file a referendum petition and to call an election thereon.
