Pending before the Court is Defendant BMW of North America, LLC’s (“BMW’s”) Motion to Dismiss Class Action Complaint of Plaintiff Martin Ehrlich Pursuant to Fed.R.Civ.P. 12(b)(6), filed on May 7, 2010.
