This matter comes before the court on Defendant’s Motion for Summary Judgment. Defendant seeks summary judgment on the ground that it cannot be bound in contract where the Forest Service of the United States Department of Agriculture (Forest Service or government) lacked actual authority to act in accordance with the contract terms alleged by plaintiff.
