MEMORANDUM AND ORDER DENYING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

GARRITY, District Judge.

This is an action brought under § 205(g) of the Social Security Act, as amended, 42 U.S.C. § 405(g), for review of a “final decision” of the Secretary of Health, Education and Welfare. In accordance with the statute, the Secretary has filed as part of his answer a certified copy of the transcript of the record including the evidence upon which the findings and decision are based. Defendant has moved for summary judgment and both parties have filed briefs on defendant’s motion.
