MEMORANDUM OPINION

AMY BERMAN JACKSON, District Judge.

Plaintiff William Havens brings this action against defendant Ray Mabus, in his capacity as Secretary of the Navy, 1 seeking review of his discharge from active duty and correction of his naval records under the Administrative Procedure Act, 5 U.S.C. § 702 (“APA”). Defendant has moved to dismiss plaintiffs amended complaint under Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6) or, in the alternative, for summary judgment. [Dkt. # 15].
