This case comes' before the Court on remand from the U.S. Court of Appeals for the District of Columbia Circuit. Plaintiff William Havens, a retired Navy Reserve officer who suffers from psoriatic arthritis, was transferred from active duty to nonactive duty in 1996 because he had not been promoted‘in two consecutive years. In 2002, he was transferred to the retired reserve, because he had been found not physically qualified to perform his duties as a reservist in 2001.
