JONES, Chief Justice.
This is a workmen’s compensation suit in which Jimmie Arnold, appellee, is the injured employee, Texas Employers Insurance Association, appellant, is the compensation carrier, and the Municipal Gas Company is the employer. Appellee instituted this suit against appellant to set aside an award of the Industrial Accident Board and to recover the statutory damages for total and permanent incapacity to labor, under the Workmen’s Compensation Law of this state (Vernon’s Tex.Civ.St.1936, art. 8306 et seq.).
