This is an application for' writ of mandate to the secretary of state to require him to certify plaintiff’s name to the various county auditors of the counties of the third judicial district to be printed on the official judicial ballot as candidate for district judge. The third judicial district elects two district judges and it appears from the complaint that at the August primary there were three candi dates in nomination and on the ballot. Their names and the votes received by them are as follows:

Harry L. Fisher, 5,043

Charles F. Koelsch, 11,537

Charles E. Winstead, 11,591
