after stating the case: Ve are compelled to differ from the learned judge, upon the admitted facts, as to the ability of plaintiffs to make a good and indefeasible title to the land described in the contract of sale, and in the deed tendered by them to the defendants therefor.
Without deciding the first important, and very interesting question, raised by the plaintiffs (for a reason hereafter given), it is proper, we think, and fair to them,- that we should, though in our own language, state the substance of their claim, and the reasoning by which it is supported, as the question…
