WAHL, Justice.

Defendant, Steven Laverne Kaiser, was found guilty by a district court jury of first-degree burglary and criminal sexual conduct in the fourth degree. The court of appeals affirmed by a 2-1 vote, rejecting defendant’s argument that he should be given a new trial because the prosecution failed to comply with the discovery rules. In the interests of justice and in order to insure that the state complies with the criminal discovery rules, we have concluded that defendant should receive a new trial.
