The defendant was indicted by the grand jury of Multnomah county for the crime of murder in the first degree, and upon a trial before a jury of that county, he was found guilty as charged in the indictment and duly sentenced to suffer the penalty of death, from which judgment this appeal is taken. Upon the argument on the appeal counsel for the prisoner argued with much force and ability two rulings of the trial court which were adverse to the appellant.
