On April 1, 1908, defendant, Lem Woon, jointly with Yee Gueng, was charged by information with the crime of murder by killing Lee Tai Hoy on March 7, 1908, and upon a separate trial was found guilty of murder in the first degree, and appeals from a judgment thereon. The homicide was committed in a building at the corner of Fourth and Pine streets, in Portland, Oregon.

Many of the assignments of error arise out of the fact that there is evidence tending to show that decedent, the two defendants, and most of the witnesses are Chinese, and are members of a Chinese society known as the “Bow On Tong”; that before the killing there was trouble in the Tong, which had divided it into two factions; and *486that decedent was blamed for this trouble.
