The defendant was indicted by the grand jury of Klamath County for being armed with a dangerous weapon, to wit, a Winchester rifle, and assaulting H. J. Chrisman with such rifle.
The evidence of the assault introduced upon the trial tended to prove that the defendant, when not less than thirty yards nor mcne than seventy yards from said Chrisman, pointed a Winchester rifle at him and threatened to kill him if he did not turn back. His words were, “Turn back, you dirty son of a b 1 or I will kill you.” The transcript shows there was. no direct evidence that the gun was loaded, or that the…
