This action was instituted by the plaintiff, E. E. Armstrong, against the defendant, Wm. Musser Lumber *585& Mfg. Company, a corporation, to recover damages for the breach of a contract of employment. The plaintiff alleged that on January 15, 1903, the defendant orally agreed to employ him as its superintendent for one year, at a salary of $2,000 per year; that said agreement was subsequently and prior to February 15, 1903, confirmed by letters and telegrams from the defendant to the plaintiff; that plaintiff entered upon the discharge of his duties and performed the same until April 15, 1904,…
