MEMORANDUM OPINION AND ORDER
SHADUR, Senior District Judge.
Trustee Thomas J. Moriarty (“Moriarty”), on behalf of the Trustees of Local Union No. 727 I.B.T. Pension Trust and the Trustees of Teamsters Local Union No. 727 Health and Welfare Trust (collectively “Funds”), has sued Glueckert Funeral Home, Ltd. (“Gluec- kert”) under Labor Management Relations Act (“LMRA”) § 301 (29 U.S.C. § 185) and Employee Retirement Income Security Act (“ERISA”) § 502(a)(3) (29 U.S.C. § 1132(a)(3)) 1 to collect delinquent employer contributions allegedly owed by Glueekert to Funds.
