MEMORANDUM OPINION AND ORDER

Thomas J. Moriarty, suing as trustee on behalf of the trustees of the Local Union No. 727,1.B.T. Pension Trust, and the trustees of the Teamsters Local Union No. 727 Health and Welfare Trust (“Funds”), sued Modell Funeral Home, Ltd. pursuant to the Employee Retirement Income Security Act (“ERISA”) section 502(a)(3), 29 U.S.C. § 1132(a)(3), and Section 301 of the Labor Management Relations Act, 29 U.S.C. § 185, for employer contributions said to be due under two employee benefit plans maintained by the trustees.
