KIRKPATRICK, District Judge.

This suit was brought, for the infringement of the complainant's trade-mark “Matzoon,” and was begun iu June, 1894, against Mugerditch Gullian, Albert Gullian, and Otto Heisenbuttel, doing business as M. Gullian & Co., iu this district, and sucli proceedings were had that on October .11, 1895, a perpetual Injunction was issued out of this court and duly served upon the said defendants.
