George Ochoa was convicted of first degree murder and sentenced to death in 1996. See Ochoa v. State, 963 P.2d 583 (Okla.Crim.App.1998). With the denial of his first federal habeas petition still under review on appeal, he now seeks to challenge his sentence on the basis that he is mentally retarded and hence ineligible for the death penalty under Atkins v. Virginia, 536 U.S. 304, 122 S.Ct. 2242, 153 L.Ed.2d 335 (2002).
