This is an appeal from a proceeding brought for a declaratory judgment to test the validity of ordinance No. 4287 of the city of Salem and to restrain the de fendants Richfield Oil Corporation and Henry Camp from constructing a service station upon the premises described in that ordinance on a lot situated at the northeast corner of the intersection of Shipping street with North Capitol street, a part of highway 99E in said city (hereinafter referred to as Lot 5).
