After a bench trial, appellant Lonzo Mitchell was convicted of possession of heroin, in violation of D.C.Code § 33-541(d) (1993 Repl.). He was sentenced to one hundred and twenty days of incarceration, with work release from five a.m. to four p.m. Mondays through Fridays. He filed a timely appeal. Mitchell contends (1) the trial court improperly denied his right to a jury trial because possession of a controlled substance is not a petty offense, and (2) the evidence was insufficient to support his conviction.
