This matter involves an appeal of a judgment of the Municipal Court of Franklin County in favor of the plaintiff Buckeye Union Insurance Company in the sum of $2,444, plus costs, against defendant, General Tire Sales, Inc.

Such action for damages was brought on the basis of subrogation rights acquired by the plaintiff insurance com pany from, its insured Donald: J. Maloney, the latter Laving been compensated for the loss of Ms automobile wMch was stolen wMle parked on the premises of the defendant.
