This action is one for wrongful death brought by the special administrator of the estate of John G. Cashman, deceased, pursuant to Minn. St. 1941, § 573.02 (Mason St. 1940 Supp. § 9657). On August 10, 1940, decedent, while riding as a guest in an automobile driven by defendant upon U. S. highway No. 371 approximately four miles southwest of the city of Brainerd, was fatally injured.
