This suit was instituted by Simmonds and Perry against the St. Louis, Brownsville & Mexico Railway Company for the value of a mule. The case was submitted to the jury upon special issues. Based upon the findings of the jury to the special issues, the trial court entered a judgment in favor of the defendant. An appeal was taken to the Court of Civil Appeals for the Fourth Supreme Judicial District at San Antonio, and the judgment of the lower court was affirmed. We refer to the opinion of the Court ‘of Civil Appeals for a full statement of the náture and result of this suit. 18 S.W.(2d) 845.
