The question in this case is whether a municipality of this state acquires a fee-simple title to property acquired for a cemetery by a statutory dedication when the property was marked on the plat as “Donated.”

In this action, Langston City, a municipal corporation, is seeking to quiet title to a tract of land so acquired against the claims of Henry K. Gustin, Harry F. Brown, and numerous others who, as heirs of and successors in interest to the dedicator, are asserting that the municipality has only an easement for cemetery purposes, and acting upon that theory have executed conveyances which…
