As cause for granting the writ the petition alleges:

“That he, the relator, is unlawfully restrained and deprived of his liberty in Boone county, Nebraska, by William J. Eerris, sheriff of said county.
“Second — That the alleged cause of the petitioner’s said restraint and detention is, that the petitioner was arrested upon a complaint made against him before Manley B. Boordman, a justice of the peace in and for said Boone county, charging the petitioner with unlawfully keeping malt, spirituous, and vinous liquors in said county with intent to sell the same without license, and…
