1. Upon the hearing, of this, a habeas corpus case, the petitioner for the writ moved to discharge and release the person in custody, upon the ground that the return of the sheriff to the writ failed to allege that the legal proceedings under which the prisoner was restrained of his liberty were had in and by a court of competent jurisdiction of the person and subject-matter. The court, while holding that the objection to the return was well taken, allowed the sheriff to amend the return so as to meet the objection.
