Gordon was arraigned in the city court of Richmond county, upon an accusation charging him with the offense of larceny from the house. Before pleading to the accusation, he filed a written demand for an indictment by the grand jury of the county of Richmond. The presiding judge refused to allow the demand, and the accused was convicted. He ex*674cepted to the ruling of the judge refusing to allow the demand, and this is the error assigned.
