The defendant-below appellant, Daniel Wien, appeals from his conviction in the Superior Court of three counts of violating the Wetlands Act. 1 On appeal Wien maintains that (1) the statute under which he was convicted is unconstitutionally vague and overbroad; and that the Superior Court erred: (2) by denying his motion to suppress evidence that (Wien contends) was the product of an illegal search of his property; (3) by excluding as irrelevant certain testimony that Wien sought to have admitted; and (4) by failing properly to instruct the jury on the mental state required to…
