"W. G. Crisp, a citizen and taxpayer of this State, residing in Fulton County, filed a suit against T. Grady Head as State revenue commissioner, seeking the writ of mandmaus to require the defendant to collect from dealers in malt beverages, one dealer being specifically mentioned, an excise tax in accordance with the act of December 13, 1937 (Ga.
