HOLLINGSWORTH, Presiding Judge.

This is an action on a “third vendor’s lien and deed of trust note” for the principal sum of $6,300, executed in the State of Texas as a part of the purchase price of land situate in that state.

Plaintiff, alleging that he was the holder in due course of the note upon which, according to its terms, there was due and payable in excess of $7,500, sought judgment against defendant as the maker thereof for the amount due.
