Kilday, Judge:

Tried by general court-martial for sodomy, in violation of Article 125, Uniform Code of Military Justice, 10 USC § 925, accused was found guilty despite his contrary plea and was sentenced to dismissal. The convening authority approved and a board of review in the office of The Judge Advocate General of the Army affirmed. Accused then sought relief before this Court and we granted his petition for review in order to consider arguments on several issues.
